Retired Supreme Court Justice William Atuguba has cautioned Speaker of Parliament Alban Bagbin about serious repercussions if he fails to adhere to the Supreme Court’s ruling.
On Tuesday, the Supreme Court, in a 5-2 decision, reversed Speaker Bagbin’s declaration of four parliamentary seats as vacant, effectively restoring the original arrangement within the House.
In a conversation with JoyNews’ Elton Brobbey, monitored by DL News, Justice Atuguba emphasized that non-compliance could result in up to 10 years of imprisonment for the Speaker, along with a potential ban from holding public office.
“It is not necessarily 10 years, you must just suffer a term of imprisonment not exceeding 10 years. Not only that, 10 years disqualification of holding public office and if you are a president, you are liable to removal,” he said.
The former Justice of the Supreme Court further noted that “Parliament is not a one man entity, it is a whole organisation, it is an organ of state so this ruling must go through certain procedural processes to give it effect so it is not an automatic thing, procedures would have to be followed.”
