Under the proposal, the Chief Justice and “not more than 14” other justices would make up the apex court, a move the Committee says is intended to streamline the Court’s work and improve the delivery of justice.

Ghana’s Constitution Review Committee has recommended capping the number of Supreme Court justices at 15, including the Chief Justice.

Under the proposal, the Chief Justice and “not more than 14” other justices would make up the apex court, a move the Committee says is intended to streamline the Court’s work and improve the delivery of justice.

The recommendation would require an amendment to Article 128(1) of the 1992 Constitution to create a formal upper limit on the Court’s size.

According to the Committee, fixing a maximum number would preserve some flexibility in future appointments while preventing uncontrolled expansion of the Supreme Court’s bench.

However, it has advised against placing similar caps on the Court of Appeal and the High Court. In its view, those courts should retain numerical flexibility so they can be expanded over time to respond to population growth, heavier caseloads and changing justice needs.

The proposals form part of a wider package of constitutional reforms the Committee has submitted to the government, aimed at strengthening the judiciary and deepening Ghana’s democratic governance.
