Private legal practitioner and lecturer, Justice Abdulai has filed a writ at the Supreme Court challenging the creation of the office of Deputy IGP in charge of operations by the president.
According to him, such an office is unconstitutional, null, and void and thus praying for the apex court to make a declaration to that effect.
A few weeks ago, the President of the Republic, Nana Akufo-Addo appointed Mr Christian Tetteh Yohuno as the new Deputy IGP in charge of operations.
However, the plaintiff avers that per a proper interpretation of Articles 202(1), 202(2), 202(3) of the 1992 Constitution, Section 3 of the Ghana Police Service Act, 1970, and the Police Service Regulations of 2012 such an appointment is null and void.
He is further seeking an order restraining the appointee, COP Yohuno from acting or purporting to act as Deputy IGP in charge of operations.
Furthermore, Mr Abdulai wants a restraining order directed at the IGP or any command under him from accepting the appointee in his assumed capacity.
