The application was withdrawn after the High Court in Accra observed that the travel permission the State wanted revoked had already expired.
The Attorney-General has withdrawn an application seeking to cancel a court order that allowed former National Food Buffer Stock Company Chief Executive Officer, Hanan Abdul-Wahab, to travel abroad for medical treatment.
The application was withdrawn after the High Court in Accra observed that the travel permission the State wanted revoked had already expired.
Mr Abdul-Wahab had been granted leave by the court to travel outside the country, with a return date of July 12, 2026.
He was, however, arrested while preparing to travel, despite the court order.
The prosecution later filed an application seeking to revoke the travel permission.
The State alleged that Mr Abdul-Wahab had attempted to withdraw money from a frozen bank account and that there were concerns he intended to abscond.
His lawyers, led by former Attorney-General Godfred Yeboah Dame, denied the allegations.
They accused the State of violating their client’s rights and challenged prosecutors to provide evidence of the alleged attempt to access the frozen account.
When the matter came before the court, Justice Francis Apanga Achibonga noted that the order permitting Mr Abdul-Wahab to travel required him to return by July 12.
The court held that since the date had passed, there was no subsisting order left to revoke.
Following the court’s observation, the prosecution withdrew the application.
Justice Achibonga subsequently struck out the application as withdrawn.
Mr Dame criticised the State’s handling of the matter, arguing that the arrest and subsequent application were in defiance of the court’s earlier order.
He maintained that his client had been prevented from enjoying the benefit of a valid court order permitting him to travel for medical care.
The dispute forms part of the wider legal battle between Mr Abdul-Wahab and the State following his arrest while facing criminal proceedings.
