The Court of Appeal has dismissed a case filed by the first accused in the ongoing ambulance case, Cassiel Ato Forson, which sought to strike out the charge sheet as ‘defective’.
The appellate court presided over by Justices Mensah, Bartels-Kodwo, and Amaleboba, held that the appeal was without merit.
Subsequent to being charged with willfully causing financial loss and intentionally misapplying public property, Hon. Ato Forson filed a motion in March 2022 at the High Court, striking out the charge sheet against him.
He averred that the particulars do not specify the alleged act engaged in, which constituted ‘without due cause and authorization.’
This was, however, dismissed by the High Court, leading to an appeal being filed at the Court of Appeal.
However, after considering the particulars of the charges, the three-member panel held that, when read together, one can hardly claim that the meaning of the words ‘without due cause and authorization’ is vague or nebulous.
The court thus established that the charges against the first accused in the ambulance case contain sufficient particulars as required under Article 19(2)(d) of the 1992 Constitution and Section 112(4) of Act 30.
