Today, the court, presided over by Justice Afia Asare-Botwe, dismissed the application for a mistrial, indicating that the minority leader did not show provisions that warrant a mistrial.
The High Court has dismissed all four (4) motions filed by the Minority Leader, Cassiel Ato Forson, and businessman Richard Jakpa.
Following the leaked voice conversation involving the Attorney General and the third accused person, the two filed four applications for the court’s consideration.
The motions included a request for an inquiry into the Attorney-General's conduct based on the allegations of Richard Jakpa, a call for a mistrial, a stay of proceedings, and a motion to dismiss the charges.
Today, the court, presided over by Justice Afia Asare-Botwe, dismissed the application for a mistrial, indicating that the minority leader did not show provisions that warrant a mistrial in this case nor probe the AG's action.
On the issue of an inquiry into the conduct of the Attorney General, the court held that the request has no legal backing while the case is pending.
Furthermore, the application by the third accused, which sought to strike out charges against him, was dismissed.
Again, the court dismissed the motion for injunction or stay of proceedings.
As such, the presiding judge directed the accused persons to resort to the General Legal Council if they have any misconduct issues against the Attorney General, Godfred Dame.
In a related occurrence, the court also advised the Attorney General, Godfred Dame, to recuse himself from the conduct of the case.
The presiding judge, however, established that the Attorney General did not seek the assistance of Mr. Jakpa to implicate the first accused in the recording.
“Having listened to the conversation between [Richard Jakpa] and AG, the allegation that AG sought assistance to implicate [Ato Forson] was not borne out of the mouth of the AG.”
