In statutory notices dated 19 January 2026, the Assembly cites Section 106 of the Local Governance Act, 2016 (Act 936), indicating the structures were erected in breach of Section 106(1) and are therefore considered unlawful.
The Accra Metropolitan Assembly (AMA) has triggered enforcement processes against developers who have put up unauthorised structures, including containers sited along Obonu Street in North Kaneshie.
In statutory notices dated 19 January 2026, the Assembly cites Section 106 of the Local Governance Act, 2016 (Act 936), indicating the structures were erected in breach of Section 106(1) and are therefore considered unlawful.
Developers have been instructed to justify their actions in writing and explain why the structures should not be altered or demolished as part of AMA’s development control mandate.
The notices require affected persons to submit their written explanations to the Metropolitan Chief Executive on or before 2 February 2026. AMA says the submission may be made by the developers themselves or through an authorised representative.
AMA further cautioned that non-compliance could expose developers to financial liability, including being surcharged for the full cost of any alteration or demolition carried out by the Assembly.
The Assembly says the action is aligned with its wider development control and city planning enforcement programme, as it scales up measures against structures and activities that undermine approved planning rules in the capital.
