The High Court (Criminal Division) has dismissed an application by former Finance Minister Kenneth Ofori-Atta seeking to overturn an arrest warrant issued against him by the Office of the Special Prosecutor (OSP).
Delivering her ruling on Wednesday, July 30, Justice Lydia Osei Marfo found no merit in the application, stating that the court had no reason to interfere with the actions taken by the Special Prosecutor.
Ofori-Atta had challenged the legality of the warrant and the subsequent Interpol Red Notice issued against him, claiming that the OSP violated due process and breached his constitutional rights. His legal team described the arrest procedures as “procedurally flawed” and lacking legal foundation.
However, the prosecution countered that the warrant was lawfully secured and executed in full compliance with the OSP’s legal mandate.
“There is no evidence before this court that the OSP acted outside its mandate,” prosecutors argued.
In her decision, Justice Osei Marfo stated, “The application is hereby dismissed in its entirety,” affirming that the arrest warrant and Red Notice remain valid and enforceable.
