The Land Division of the High Court in Accra has issued a temporary injunction in favor of Labadi Beach Hotel, barring Spartan Ives Limited, the operators of Polo Beach Club, from encroaching on its property.
The injunction, granted on December 19, 2024, stems from a legal dispute initiated by Hotel Investments (Ghana) Limited, the hotel's owners, to reclaim contested land.
The court order specifically restricts Spartan Ives Limited and its associates from:
- Trespassing on the 0.54-acre portion of the hotel’s property, including its use for parking, pathways, or event hosting.
- Operating the Polo Beach Club or organizing events on the disputed land or other restricted areas adjacent to the hotel.
- Utilizing the beachfront near the hotel’s property in violation of a lease agreement dated November 27, 1990.
The injunction, valid for 10 days, includes a warning of contempt of court proceedings if the defendants fail to comply.
This legal move underscores Labadi Beach Hotel’s commitment to protecting its property rights against alleged encroachment. Supporting affidavits from the hotel’s management, led by David Eduaful, emphasize the need to uphold its reputation as Ghana’s premier 5-star beach resort.
The court’s decision marks a key development in the hotel’s efforts to address land disputes and ensure a peaceful environment for its guests. Updates on the case are anticipated as it progresses.
