A High Court in Kumasi has struck out part of an application linked to the estate of late highlife musician Charles Kwadwo Fosuh, widely known as Daddy Lumba, after one of the listed applicants told the court she never authorised her inclusion.

On Monday, Justice Hannah Taylor upheld a misjoinder motion filed for Charlyn Fosuh, a daughter of the deceased, effectively removing her from an application seeking letters of administration over her father’s estate.

Her lawyer, Enoch Afoakwah, told the court his client had neither agreed to be part of the case nor been informed of any affidavit sworn in her name.

He said she wants estate matters handled within the family first, rather than through prolonged court battles.

Mr Afoakwah said the children of the late musician remain aligned in protecting their father’s legacy and believe discussions should be exhausted internally before litigation is pursued.

He also argued that his client considers the use of her name without permission a breach of trust among siblings, and insisted the family is not backing any side in what is shaping up as a broader dispute.

The lawyer acknowledged that Ghana’s intestate succession framework allows the deceased’s spouse, children, surviving parents and customary successor to apply for letters of administration.

He said, on that basis, Akosua Serwaa Fosuh (named as the widow) and Akosua Bimpomaa Fosuh (described as the customary successor) have capacity to bring such an application.

However, he maintained that if the children decide to proceed, the process should, in line with family order and custom, be led by the eldest son, Calvin Fosuh.

Mr Afoakwah urged a non-adversarial path, saying the family’s priority is peace and unity.
