The ECOWAS Court has delivered a landmark judgment in favor of Shalimar Abbiusi, spokesperson for the New Force, against the Republic of Ghana for breaching her fundamental rights.
The court ruled that Ghana had violated Ms. Abbiusi's rights through wrongful arrest, repeated rearrests, and unlawful deportation in December 2023.
These actions were deemed to have caused significant harm to her personal and professional reputation.
The court determined that the actions of the Ghana Immigration Service contravened Article 6 of the Liberty of People, especially given that all charges against Ms. Abbiusi had been dismissed by the State Prosecutor. This decision highlights a breach of her rights despite the lack of legal grounds for her treatment.
The court ordered the Ghanaian government to compensate Ms. Abbiusi, underscoring the importance of justice and accountability.
Francis-Xavier Sosu, Esq., the Member of Parliament for Madina, who represented Ms. Abbiusi alongside Lawyer Belinda Narkey Quaynor, welcomed the ruling. "The court’s decision affirms the protection of fundamental human rights, and we feel vindicated," Mr. Sosu stated.
The New Force expressed its satisfaction with the outcome, emphasizing its commitment to promoting fairness and justice across Africa. They called on the Ghanaian government to uphold constitutional guarantees of human rights and the rule of law.
“The treatment of Ms. Abbiusi reflects a larger pattern of political persecution that undermines democracy in Ghana,” the New Force asserted. They also urged civil society groups, human rights advocates, and the global community to denounce such violations and support institutional reforms to prevent future injustices.
