The Ghana Bar Assocition is concerned about the lack of clear and comprehensive regulations guiding impeachment or removal of Chief Justice and superior court Justices.

According to the Association, this development greatly affect the standards to be met in such processes.

Speaking the opening of the 2025 Bar Conference in Wa, President of the Association, Madam Efua Ghartey recalled an April 30 resolution urging Parliament to enact such regulations.

She noted however that no such rules still exist today despite the above move.

“The lack of an enactment for such rules in the case of the removal of the 4th-highest person in the nation should be a matter of concern for all of us. These rules should have been known to all and sundry before the commencement of the process, as it greatly affects the standard to be met. It ends up being an unfortunate precedent which lacks fairness,” she cautioned.

Mrs Ghartey acknowledged that the Constitution allows for the removal of superior court judges, but argued that the absence of well-defined procedural rules creates a risk of arbitrariness.

Emphasising the principle of equal access to justice, the GBA President stressed that fairness should not depend on social, political, or economic status
