A Ghanaian tech expert and music producer, Kobby Spiky Nkrumah has been awarded $250,000 by the Commercial Court in Accra in a copyright case filed against the Confederation of African Football(CAF).
Kobby sued the Continental Football Association for using the beat of his music titled; ‘Okomfo Anokye,’ for their 2018 awards without his permission.
In its judgment, the court presided over by Justice Emmanuel Loddoh thus ordered CAF to pay damages amounting to the Ghana Cedis equivalent of USD 250,000, along with legal costs of GHS 40,000.
Her averred that CAF’s unauthorized use of his music was a blatant disregard for his intellectual property rights, resulting in financial losses from potential licensing deals.
Before taking legal action, Spiky had publicly accused CAF of copyright infringement in 2019 through a series of tweets.
He mentioned that despite CAF's email admission and apology for using his work without consent, they failed to respond to his compensation request.
Even though the Association acknowledged its mistake, it argued that the music was freely available online without any usage restrictions.
