The office has come under intense criticism in recent times concerning its bail conditions, which many have described as excessive and illegal.
However, speaking on Asempa FM’s Ekosii Sen, EOCO Legal Officer Paa Brew Sam explained that the Office operates under the Criminal and Other Offences (Procedure) Act, 1960 (Act 30).
Mr. Sam pointed out that Section 15 of Act 30 empowers EOCO to grant police inquiry bail, while Section 96 gives the courts authority to grant bail pending trial or appeal.
He added that the seriousness of an offence often influences the terms of bail, noting that EOCO’s approach is consistent with both the Constitution and established legal procedures.
