Two individuals accused of granting the same parcel of land to different buyers have been granted bail in the sum of GH¢2 million each by an Accra Circuit Court.

The accused, Nene Ebenezer Mormo Kissiedu Nyamaa II, a farmer, and George Kenneth Tetteh, a retired educationist, are alleged to have sold land to a businessman despite knowing that portions of the property had previously been granted to other persons.

The court admitted them to bail with three sureties each, one of whom must be justified.

They were also directed to report to the police investigator once every week as investigations and court proceedings continue.

The case has been adjourned to November 16, 2026.

How the land dispute began

Presenting the facts to the court, Assistant Superintendent of Police (ASP) Seth Frimpong explained that the complainant, Francis Godsway Ntem, a trader residing in Tema, was introduced to the accused between 2021 and 2022 while searching for land for development.

According to the prosecution, the accused informed the complainant that they had land available around Asutsuare Junction along the Akosombo main road.

Following discussions, they allegedly sold approximately 1,009 acres to the complainant and issued him an indenture covering the transaction.

However, the arrangement became the subject of a dispute when the complainant attempted to develop the property.

He was reportedly confronted by another individual, Ibrahim Yakubu, also known as Sariki Awala, who claimed that the land belonged to him.

Investigations uncover earlier land transactions

The prosecution told the court that subsequent investigations revealed a series of earlier transactions involving portions of the disputed property.

According to ASP Frimpong, Yakubu had acquired approximately 628.12 acres at Luom-Osudoku in 2010 from the late Chief of Luom.

Following the acquisition, Yakubu reportedly undertook development activities on the land, including establishing a livestock farm and granting portions of the property to other individuals.

The prosecution further disclosed that the Gbesedorm Clan had, in October 2019, granted approximately 3,211 acres to the Aworteye Narh Family, with the transaction allegedly covering portions of the land claimed by Yakubu.

The dispute subsequently became the subject of court proceedings concerning ownership and related interests in the property.

ASP Frimpong explained that the accused, acting in their respective capacities as Stool Priest and Secretary of the Gbesedorm Clan, participated in another transaction involving the land.

Together with other clan representatives, they allegedly relied on a Supreme Court judgment delivered on July 7, 2021, to re-grant the land to Yakubu through an indenture dated January 3, 2022.

Accused deny allegations

The prosecution maintains that Nyamaa II and Tetteh were aware of the earlier transactions involving the disputed land but nevertheless accepted payment from the complainant and granted him an interest in the same property.

ASP Frimpong told the court that the accused were subsequently arrested, cautioned and charged following investigations into the complaint.

They were initially granted police enquiry bail before appearing before the Circuit Court.

However, both accused persons have denied conspiring to grant the same land to more than one individual.

The court subsequently granted them GH¢2 million bail each, subject to the stipulated surety requirements and weekly reporting conditions.

The matter will return to court on November 16, 2026, for further proceedings.

The competing ownership claims and criminal allegations remain unresolved and are subject to determination through the appropriate legal processes.
