The case was brought by Akosua Serwaa Fosuh, who is asking the court to recognise her as the musician’s sole surviving wife.

A High Court in Kumasi is preparing to deliver judgment in a contentious family dispute over who has the legal right to perform widowhood rites for the late highlife icon Charles Kwadwo Fosuh, known widely as Daddy Lumba.

The case was brought by Akosua Serwaa Fosuh, who is asking the court to recognise her as the musician’s sole surviving wife.

She is seeking an order granting her exclusive authority to perform traditional widowhood rites at his funeral, and a further injunction preventing Priscilla Ofori, popularly called Odo Broni, from presenting herself as the musician’s spouse.

Also joined to the suit are:

Abusuapanin Kofi Owusu, head of the Ekuona family at Parkoso in Kumasi

Transitions Funeral Home, Accra

Four witnesses have already taken the stand:

the legal representative of Akosua Serwaa Fosuh

Ernestina Fosuh, elder sister of the late musician

Osei Sarfo Kantanka, an Akan customary expert from the Manhyia Palace

Abusuapanin Kofi Owusu of the Parkoso Ekuona family

At least two further defence witnesses are expected as the hearing continues on Monday, 24 November 2025.

The presiding judge, Her Ladyship Justice Dorinda Smith-Arthur, had initially planned to deliver judgment on November 25, but has now shifted the ruling to Friday, November 28, 2025.

She has ordered all parties to file their written submissions by Wednesday, which requires that cross-examinations and legal arguments be wrapped up by Tuesday.

If the schedule holds, the court would have managed the entire case—described by lawyers as emotionally charged and complex—in less than two weeks.

Justice Smith-Arthur’s courtroom management has drawn admiration from counsel on both sides. Known for a firm yet occasionally light-hearted approach, she has kept the proceedings brisk and focused.

The court resumes this morning, with counsel for Akosua Serwaa Fosuh set to continue the cross-examination of Abusuapanin Kofi Owusu. The ruling at the end of the week will determine who Ghanaian custom—and the law—recognises as the rightful widow of the highlife legend.
